Abstract

‘WHO REGULATES THE REGULATORS?’ This is a question well worth posing, and one answer to it is: the High Court in the exercise of its supervisory jurisdiction of judicial review. An example of its exercise over the SIB will be seen now that the High Court has given leave to the IFA association and LIBM Ltd (a firm of professional indemnity insurers) to apply for a judicial review of the SIB pension transfer compensation guidelines. The applicants' legal arguments are that:
