Tenant, lodger, patient?: The legal status of residents in supported housing

Abstract

This article is particularly concerned with residents who fall short of the test of contractual capacity, that is, of understanding the nature of the contract they are entering into. Elderly people and those with severe learning difficulties have become a cause of concern because of uncertainty about their status as residents.
