Red tape uncertainty jeopardising health claims

A range of scientific claims that support the health and nutritional benefits of dairy products are being jeopardised because of a lack of clarity in the claims process devised by EU regulators.

Speaking at the Whey Innovation seminar in Amsterdam Judith Bryans, Director for the Dairy Council and Chair of the IDF Standing Committee on Nutrition and Health warned of potential causalities in health claims due to the uncertainty around EU regulations.

Dr Bryans said: “The claims process did not adequately define how the evidence for proposed claims would be weighted before applicants submitted claims to meet regulatory deadlines. This has lead many companies to withdraw their health claims altogether”.

“Changes are being made to the process that will help applicants in the future but not the huge numbers who've already put in claims which may well be rejected and not pass the evaluation process”.

“In order to have a good chance to pass the evaluation process, claims put forward need good human studies which show clearly a relationship between the product and a beneficial effect on health. The process is getting clearer as time goes on, but the way in which the science would be evaluated should have been clearly stipulated from the beginning”.
